An Act to create provisions governing litigation financing. Be it enacted by the Legislature of the State of South Dakota: Section 1. That a NEW SECTION be added to a NEW CHAPTER in title 54: [ADDED: Terms used in this Act mean:] [ADDED: (1) "Consumer," any individual who resides or is present in this state or who is or may become a claimant or a plaintiff in a civil action or an administrative proceeding, or in pursuit of any claim or cause of action in this state;] [ADDED: (2) "Division," the Division of Banking;] [ADDED: (3) "Entity," any domestic or foreign corporation, partnership, limited partnership, limited liability company, trust, fund, plan, or any other business, enterprise, association, or organization;] [ADDED: (4) "Foreign country of concern," a foreign government listed in 15 C.F.R. § 791.4 (January 1, 2025);] [ADDED: (5) "Foreign entity of concern," an association, corporation, organization, partnership, or other combination of persons:] [ADDED: (a) Organized or incorporated in a foreign country of concern;] [ADDED: (b) Owned or controlled by the government, a political subdivision, or a political party of a foreign country of concern;] [ADDED: (c) That has a principal place of business in a foreign country of concern; or] [ADDED: (d) Owned, organized, or controlled by or affiliated with a foreign organization that has been placed on the …
