West Virginia HB3116: Relating to incest

The purpose of this bill is to expand definitions of certain relatives under the statute governing incest to include aunts and uncles by marriage, and aunts and uncles in same-sex marriages.

To amend and reenact §61-8-12 of the Code of West Virginia, 1931, as amended, relating to incest; and defining terms applicable to crime of incest. Article 8. crimes against chasitity, morality and decency. §61-8-12. Incest; penalty. (a) For the purposes of this section: (1) "Aunt" or (B) The wife of a person's uncle or aunt; (2) "Brother" means the son of a person's mother or father; (3) "Daughter" means a person's natural daughter, adoptive daughter, or the daughter of a person's husband or wife; (4) "Father" means a person's natural father, adoptive father, or the husband of a person.
