A BILL FOR An Act relating to the sale of nitrous oxide. BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: TLSB 5799YH (2) ss/ko H.F. 2140 Section 1. Section 126.22, Code 2026, is amended by adding the following new subsection: NEW SUBSECTION. 3. Permit required. A person shall not distribute nitrous oxide in this state without a nitrous oxide distribution permit issued by the department of inspections, appeals, and licensing. A nitrous oxide distribution permit holder shall maintain a log of each sale of nitrous oxide. The department of inspections, appeals, and licensing shall adopt rules pursuant to chapter 17A to implement this subsection. EXPLANATION The inclusion of this explanation does not constitute agreement with the explanation's substance by the members of the general assembly. This bill prohibits a person from distributing nitrous oxide in this state without a permit issued by the department of inspections, appeals, and licensing. The bill requires a nitrous oxide distribution permit holder to maintain a log of each sale of nitrous oxide. LSB 5799YH (2) -1- ss/ko 1/1
