FIRST REGULAR SESSION HOUSE BILL NO. 1253 103RD GENERAL ASSEMBLY INTRODUCED BY REPRESENTATIVE NOLTE. 2810H.01I JOSEPHENGLER,ChiefClerk To repeal section 304.016, RSMo, and to enact in lieu thereof one new section relating to passing zones, with a penalty provision. Section A. Section 304.016, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 304.016, to read as follows: 304.016. 1. The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to the limitations and exceptions hereinafter stated: (1) The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle; and (2) Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle and shall not increase the speed of such driver's vehicle until completely passed by the overtaking vehicle. 2.
