An Act An Act concerning structured settlements and amending and supplementing P.L.2001, c.139 (C.2A:16-63 et seq.). Be It Enacted by the Senate and General Assembly of the State of New Jersey: 1. Section 2 of P.L.2001, c.139 (C.2A:16-64) is amended to read as follows: 2. For the purposes of [this act] [ADDED: P.L.2001, c.139 (C.2A:16-63 et seq.) and P.L. , c. (C. ) (pending before the Legislature as this bill)] : Annuity issuer means an insurer that has issued a contract to fund periodic payments under a structured settlement. Commissioner means the Commissioner of Banking and Insurance. "Dependents" includes a payee's spouse and minor children and all other persons for whom the payee is legally obligated to provide support, including alimony. Discounted present value means the present value of future payments determined by discounting those payments to the present using the most recently published applicable federal rate for determining the present value of an annuity, as issued by the United States Internal Revenue Service. [ADDED: Effective annual interest rate means the effective rate of interest per year the payee will be paying the transferee based on the net advance amount that a payee will receive from the transferee and the amounts and timing of the structured settlement payments that the payee is transferring to the transferee.] Gross advance amount …
