An Act concerning the definition of veteran for the purpose of affordable housing preference and amending P.L.1985, c.222. Be It Enacted by the Senate and General Assembly of the State of New Jersey: 1. (New section) The Legislature finds and declares that: a. P.L.2013, c.6 established an affordable housing preference for low- and moderate-income veterans who served in time of war or other emergency by authorizing a municipality to enter into an agreement with a developer or residential development owner to provide a veterans preference for up to 50 percent of the affordable units in a particular project. b. At the time P.L.2013, c.6 was enacted, section 1 of P.L.1963, c.171 (C.54:4-8.10) defined active service in time of war. The definition of veteran in subsection (h) of that section required honorable discharge or release under honorable circumstances from active service in time of war. c. P.L.2019, c.413, which extended certain veterans property tax benefits to qualifying veterans who had not served in time of war, deleted the definition of active service in time of war from section 1 of P.L.1963, c.171 (C.54:4-8.10) and removed the wartime-service requirement from the definition of veteran in subsection (h) of that section. These statutory changes were contingent upon voter approval of a constitutional amendment authorizing the extension of those benefits to veterans who did …
