AN ACT RELATING TO BUSINESS; ENACTING THE DATA BROKER PRIVACY ACT; CREATING THE DATA BROKER PRIVACY FUND; PROVIDING PENALTIES. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: SECTION 1. [NEW MATERIAL] SHORT TITLE.--This act may be cited as the "Data Broker Privacy Act". SECTION 2. [NEW MATERIAL] DEFINITIONS.--As used in the Data Broker Privacy Act: A. "consumer" means a natural person who is a resident of New Mexico and who purchases, leases or otherwise contracts for products, goods or services within New Mexico that are primarily used for personal, family or household purposes; B. "data broker" means a person that knowingly collects and sells to third parties the personal information of a consumer with whom the person does not have a direct relationship; provided that "data broker" does not mean: (1) a person to the extent that it is covered by the federal Fair Credit Reporting Act; or (2) a person to the extent that it is covered by the federal Gramm-Leach-Bliley Act and implementing regulations; D.
