AN ACT to amend the education law, in relation to exempting school districts located within a nuclear emergency planning zone from zeroemission school bus requirements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Section 3638 of the education law is amended by adding a new subdivision 8 to read as follows: 8. (A) NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE REQUIREMENTS OF SUBDIVISIONS TWO AND THREE OF THIS SECTION SHALL NOT APPLY TO ANY SCHOOL DISTRICT LOCATED WHOLLY OR PARTIALLY WITHIN A TENMILE PLUME EXPOSURE PATHWAY EMERGENCY PLANNING ZONE SURROUNDING A NUCLEAR POWER FACILITY. (B) NOTHING IN THIS SUBDIVISION SHALL PROHIBIT A SCHOOL DISTRICT FROM VOLUNTARILY PURCHASING, LEASING, OR OPERATING ZERO-EMISSION SCHOOL BUSES. (C) THE COMMISSIONER SHALL PUBLISH AND MAINTAIN A LIST OF SCHOOL DISTRICTS THAT QUALIFY FOR EXEMPTION UNDER THIS SUBDIVISION. § 2. This act shall take effect immediately.
