A BILL for an Act to create and enact a new section to chapter 35-27 of the North Dakota Century Code, relating to a debris removal lien. BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA: SECTION 1. A new section to chapter 35-27 of the North Dakota Century Code is created and enacted as follows: Debris removal lien - Limitations - Notice of insurance proceeds - Release of lien . 1. Notwithstanding any other provision of law, a receipt by an insurance company of a claim under a fire insurance policy for a total loss to real property creates a lien on the insurance proceeds payable for the claim in favor of the city in which the property is located, or if the property is located outside a city, the county in which the property is located. The amount of the lien under this subsection is the greater or b. Ten percent of the policy limits for loss to the real property, including any coverage for debris removal. 2. A lien created under this section may not exceed the policy limits of coverage for the real property plus debris removal. The lien does not apply to proceeds payable under the policy for any losses other than those to the real property insured, including loss of personal property and …
