An Act relating to protection of veterans; requiring Attorney General to enforce provisions of federal law related to payments made to escrow or title companies in certain real estate transactions; providing for civil penalty; amending 74 O.S. 2021, Section 19.1, which relates to the Attorney General Law Enforcement Revolving Fund; providing for codification; and providing an effective date. BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 451 of Title 72, unless there is created a duplication in numbering, reads as follows: A. The Attorney General shall enforce the requirements of C.F.R. Section 36.4303(k) or any other federal law or rule that requires earnest money paid by a qualified United States veteran or active duty military to an escrow company or title company or other entity acting in such capacity to be returned if the value of the property appraises for less than the contract price. SENATE FLOOR VERSION - HB4301 SFLR Page (Bold face denotes Committee Amendments) B. Any person or entity violating the requirements of federal law as described in subsection A of this section shall pay a civil penalty of Five Hundred Dollars ($500.00) per occurrence.
