PRINTER'S NO. 3909 THE GENERAL ASSEMBLY OF PENNSYLVANIA HOUSE BILL No. Session of INTRODUCED BY GUZMAN, FLICK, DEASY, HAMM, CEPEDA-FREYTIZ, INGLIS, JAMES AND IRVIN, SEPTEMBER 23, 2026 REFERRED TO COMMITTEE ON GAMING OVERSIGHT, SEPTEMBER 24, 2026 Providing for a temporary transition period for certain skill game devices and for expiration. The General Assembly of the Commonwealth of Pennsylvania hereby enacts as follows: Section 1. Short title. This act shall be known and may be cited as the Skill Game Temporary Transition Act. Section 2. Findings and declarations. The General Assembly finds and declares as follows: (1) On June 15, 2026, the Supreme Court of Pennsylvania held in In re Three Pennsylvania Skill Amusement Devices, 358 A.3d 385 (Pa. 2026), that certain skill game devices are subject to 4 Pa.C.S. Pt. II (relating to gaming) and 18 Pa.C.S. § 5513 (relating to gambling devices, gambling, etc.). (2) The Supreme Court of Pennsylvania stayed its order for 120 days in recognition of the reasonable reliance on prior case law regarding the lawfulness of skill game devices and the potential disruption to business owners and other good faith participants in the skill game industry. (3) The 120-day period established by the Supreme Court of Pennsylvania expires October 13, 2026. (4) The General Assembly is considering legislation regarding the future of skill games in …
