It is unlawful for a person to manufacture, sell, offer for sale, ship, or cause to be shipped or received into or within this state, except as provided in law, any item of fireworks, without first having secured the required applicable permit, as a manufacturer, distributor, wholesaler, retailer or seasonal retailer, from the state fire marshal. A "seasonal retailer" means a person engaged in the business of making retail sales of fireworks within this state from June 20 through July 5 and December 10 through January 2 of each year. Until February 1, 2027, this bill adds that, from May 1, 2026, through January 31, 2027, "seasonal retailer," instead, means a person engaged in the business of making retail sales of fireworks within this state from May 20 through May 30, June 10 through July 10, September 1 through September 10, and December 10 through January 3. FEES Present law requires the state fire marshal to charge specific fees for each classification of permit, such as $1,000 for a retailer and $100 for a seasonal retailer. Other permit classifications are manufacturer, distributor, wholesaler, and exhibitor. A person engaged in more than 1 classification must only pay one fee based upon the classification requiring the higher fee. Until February 1, 2027, this bill raises the fee amount for a seasonal retailer from $100 to $150. RULEMAKING This bill authorizes the state fire marshal to promulgate rules to effectuate this bill.
